Cancellation Policy

This Cancellation Policy (the “Policy”) governs all cancellations, changes and refunds relating to services and products provided by Travel With Daneev (“Travel With Daneev,” “we,” “us” or “our”). It forms part of, and is to be read together with, our Terms & Conditions. By paying a planning fee, purchasing a product, approving a booking or otherwise engaging our services, you (the “Client”) acknowledge that you have read, understood and agreed to this Policy.

1. Definitions

• “Services” means the travel planning, advisory and coordination services provided by Travel With Daneev, including any add-on services.

• “Planning Fee” means any fee paid to Travel With Daneev for Services, including consultation, add-on and rush planning fees.

• “Digital Products” means Signature Itineraries, destination guides and any other materials delivered electronically.

• “Supplier” means any third party that provides travel services, including airlines, hotels, resorts, cruise lines, tour operators, transportation companies, vacation rental companies, activity providers and other vendors.

• “Booking” means any reservation or purchase made with a Supplier on the Client’s behalf or at the Client’s direction.

2. Role of Travel With Daneev

Travel With Daneev is an independent travel advisor affiliated with its host agency, Luxx Escapes LLC. Travel With Daneev plans, recommends and coordinates travel arrangements with Suppliers on the Client’s behalf. Travel With Daneev does not own, operate, manage or control any Supplier and does not itself provide transportation, accommodation, tours or any other travel service. The contract for each travel service is between the Client and the Supplier that provides it.

3. Planning Fees

Planning Fees compensate Travel With Daneev for professional time, research, itinerary design, Supplier communication and ongoing support. That work begins when payment is received. Accordingly, all Planning Fees are earned upon receipt and are non-refundable, whether or not the Client travels, completes a Booking, or later changes or cancels the trip.

The sole exception is where Travel With Daneev cancels an engagement before any work has begun, in which case the Planning Fee for that engagement will be refunded in full.

Planning Fees are those published on our website, or quoted to the Client in writing, at the time of purchase. Planning Fees do not include airfare, accommodation, excursions, transportation, travel insurance, taxes, gratuities or any other Supplier cost.

4. Signature Itineraries and Digital Products

Digital Products are delivered electronically and become accessible upon purchase. All sales of Digital Products are therefore final and non-refundable.

Digital Products are provided for informational and planning purposes only. They do not include Booking, reservation management, Supplier negotiation, itinerary monitoring or concierge support unless expressly stated in writing. Prices, availability, operating hours and other details in a Digital Product reflect the information available when it was prepared and may change without notice. The Client is responsible for confirming all details directly with the relevant Supplier before travel.

Digital Products are licensed to the purchaser for personal, non-commercial use only. They may not be reproduced, distributed, resold, published or shared publicly in any form. Travel With Daneev may update, rename or discontinue any Digital Product at any time.

5. Cancellation by the Client

A Client who wishes to cancel a trip or any Booking must give written notice by email to daneev@travelwithdaneev.com. A cancellation takes effect only when Travel With Daneev acknowledges that notice in writing. Verbal requests and messages sent through social media are not valid notice.

Upon a Client cancellation:

• Planning Fees are not refunded.

• Every Booking is subject solely to the cancellation, refund and credit terms of the Supplier that holds it. Many fares, promotional rates, group contracts, cruises, villas and tours are wholly non-refundable from the moment they are booked.

• Any refund or credit due from a Supplier is issued by that Supplier, in the form and on the timeline that Supplier determines. Travel With Daneev does not advance, guarantee or pay Supplier refunds.

Travel With Daneev is not responsible for Supplier cancellation penalties, non-refundable deposits, fare restrictions, expired travel credits, processing fees, change fees or currency fluctuations.

6. Cancellation or Change by a Supplier

Suppliers may cancel, reschedule, overbook, substitute or otherwise change the services they have agreed to provide, and may cease operations altogether. These decisions are made by the Supplier alone and are outside the control of Travel With Daneev.

Where a Supplier cancels, changes or fails to provide any service:

• Responsibility rests solely with that Supplier.

• The Client’s remedies are limited to those offered by the Supplier under its own terms, together with any benefits available under the Client’s travel insurance.

• Travel With Daneev will make commercially reasonable efforts to assist the Client in seeking a refund, credit or alternative arrangement from the Supplier, but does not guarantee any outcome.

• Travel With Daneev has no obligation to refund, reimburse or compensate the Client for any resulting loss, cost or inconvenience, and Planning Fees remain non-refundable.

Where replacement arrangements require substantial new planning, additional Planning Fees may apply and will be quoted before any further work begins.

7. Cancellation by Travel With Daneev

Travel With Daneev may decline or end an engagement at any time if the Client fails to make a payment when due, provides false or incomplete information, fails to respond to requests needed to proceed, behaves abusively toward Travel With Daneev or any Supplier, or requests arrangements that are unlawful or unsafe. In those circumstances, Planning Fees paid are not refunded and Bookings already made remain subject to Supplier terms.

8. Changes and Modifications

Requests to change travel dates, destinations, travelers, accommodation or other itinerary details must be made in writing. All changes are subject to Supplier availability, Supplier approval and current pricing, and cannot be guaranteed once a Booking is confirmed.

Minor revisions may be accommodated without charge at the discretion of Travel With Daneev. Substantial changes, including a change of destination or dates, a rebuilt itinerary, added travelers, a change of Supplier or the rebooking of cancelled travel, may require additional Planning Fees, rush fees or a new service agreement. The Client is responsible for all Supplier penalties, fare differences and price increases resulting from a change.

9. Rush Planning and Expedited Services

Rush planning is subject to additional fees and to availability, which depends on Supplier response times, trip complexity and current capacity. Rush fees are non-refundable once work has begun, whether or not the travel is ultimately booked, changed, postponed or cancelled.

10. Group Travel

Group planning fees and per-traveler fees are those published on our website at the time of purchase. The group organizer is responsible for making sure every traveler in the group understands and accepts the payment deadlines, Supplier terms, documentation requirements and this Policy.

Travel With Daneev is not responsible for disputes between travelers, cancellations or no-shows by individual travelers, missed payments by group members, or changes requested by individual participants. Group rates, room blocks and contracted prices may change if the size of the group changes after deposits have been paid. Late additions, extensive changes and separate payment arrangements may incur additional fees.

11. Airfare

Airfare prices and availability change continuously and are not guaranteed until a ticket is issued. The Client is responsible for reviewing and approving all flight details before ticketing. Where Travel With Daneev processes a flight Booking using the Client’s payment method, a signed credit card authorization is required first.

Most airfare is non-refundable and may be subject to change penalties or airline-issued credits only. Travel With Daneev is not responsible for schedule changes, cancellations, delays, missed connections, denied boarding, seat changes, baggage fees or fare increases before ticketing.

12. No-Shows and Unused Services

No refund is due from Travel With Daneev for any service the Client does not use, in whole or in part, for any reason, including late arrival, missed departure, early return or a decision not to travel. Any refund for an unused service is determined solely by the Supplier.

13. Travel Insurance

Travel With Daneev strongly recommends that every traveler purchase comprehensive travel insurance covering trip cancellation, trip interruption, medical emergencies, emergency evacuation, delay, baggage loss and Supplier default. Travel With Daneev is not an insurer and does not determine coverage or the outcome of any claim. The Client is responsible for selecting a policy and reviewing its terms.

A Client who declines travel insurance accepts full financial responsibility for any loss that insurance would have covered.

14. Passports, Visas and Entry Requirements

Each traveler is solely responsible for holding a valid passport and any visa, permit, vaccination record or other document required for the trip, and for complying with all entry, health and customs requirements. Guidance offered by Travel With Daneev is general information only and must be verified with the relevant government authority.

Travel With Daneev is not responsible for denied boarding, refused entry or any cost arising from missing, invalid or expired documentation, and no refund is due in those circumstances.

15. Force Majeure

Travel With Daneev is not liable for any delay, cancellation, interruption, loss or expense caused by events beyond its reasonable control, including severe weather, natural disasters, epidemics and public health emergencies, acts of terrorism, war, civil unrest, government orders, border closures, labor disputes, transportation disruptions and Supplier insolvency. In any such event, refunds, credits and alternatives are governed solely by Supplier terms and the Client’s travel insurance, and Planning Fees remain non-refundable.

16. Concierge and Add-On Services

Add-on services, including on-trip concierge support, celebration enhancements, content and photo planning and transportation coordination, depend on destination availability and on the participation of independent third-party vendors. Travel With Daneev arranges these services but does not operate them, employ the vendors or guarantee their performance. Separate vendor deposits, contracts, cancellation terms and price changes may apply. Fees paid to Travel With Daneev for add-on services are non-refundable once coordination has begun.

17. Chargebacks and Payment Disputes

The Client agrees to contact Travel With Daneev in writing and allow a reasonable opportunity to resolve any billing concern before initiating a dispute with a bank or card issuer.

Planning Fees are payment for professional services rendered, and Digital Products are fulfilled upon delivery. The Client agrees not to initiate a chargeback or payment reversal for Services that have been performed or Digital Products that have been delivered. If a chargeback is initiated, Travel With Daneev may suspend all Services, may submit this Policy, the Client’s communications and proof of delivery to the card issuer or payment processor, and may recover from the Client the disputed amount together with any fees and reasonable costs incurred as a result of a dispute found to be improper.

18. Client Responsibilities

The Client is responsible for:

• providing complete and accurate information, including traveler names exactly as they appear on passports;

• reviewing all itineraries, confirmations and travel documents promptly and reporting any error at once;

• meeting all payment deadlines; and

• responding in a timely manner to requests for approvals, payments and confirmations.

Travel With Daneev is not responsible for any loss arising from inaccurate information supplied by the Client, or from a delay in the Client’s response that affects pricing, availability or timelines. Where an intake form is requested before a consultation, it must be submitted at least 48 hours before the appointment; otherwise the consultation may be rescheduled.

19. Limitation of Liability

To the fullest extent permitted by law, Travel With Daneev is not liable for any act, omission, error, delay, cancellation, injury, illness, loss or damage caused by a Supplier or by any event outside the direct control of Travel With Daneev. The Client acknowledges that travel involves inherent risks and voluntarily assumes them.

To the fullest extent permitted by law, Travel With Daneev is not liable for any indirect, incidental, consequential, special or punitive damages, and its total liability for any claim arising from its Services will not exceed the Planning Fees the Client paid to Travel With Daneev for the trip concerned. Nothing in this Policy excludes or limits any liability that cannot be excluded or limited under applicable law.

20. Governing Law and Venue

This Policy is governed by the laws of the State of Florida, without regard to its conflict of laws rules. Any legal proceeding arising from this Policy or from the Services must be brought exclusively in the state or federal courts located in Orange County, Florida, and the Client consents to the jurisdiction of those courts.

21. General

If any provision of this Policy is held unenforceable, the remaining provisions continue in full force. Travel With Daneev may amend this Policy at any time by posting a revised version on its website; the version in effect on the date of the Client’s purchase applies to that purchase. This Policy and the Terms & Conditions together form the entire agreement between the Client and Travel With Daneev on these subjects.
